What is NLADA Mutual Insurance Co., A Risk Retention Group?

The NLADA Mutual Insurance Co., A Risk Retention Group, (known as NLADA Mutual) is America’s first and only equal justice insurance and risk management insurance firm exclusively dedicated to equipping you with the coverage you need to courageously and confidently advance justice and equity for all. As an evolved version of the NLADA Insurance Program, we are committed to providing the excellent products and services to which you are accustomed.

What is a mutual insurance company and why does it matter?

A mutual insurance company is owned entirely by its policyholders and governed by a board of directors on behalf of the policyholders. In this instance, NLADA member-insureds own NLADA Mutual and members of this community serve on its board. We are distinct because NLADA Mutual was established by and for the equal justice leaders and advocates in the field and related organizations, all of whom together make access to justice possible.

What is A Risk Retention Group?

A Risk Retention Group (or “RRG”) is a specific type of mutual insurance company that can operate in all states and the District of Columbia after being formed and licensed in one state. RRGs are authorized by federal law. RRGs are closely regulated by the jurisdiction in which they are domiciled and licensed. NLADA Mutual is licensed in the District of Columbia and can provide coverage anywhere in the United States.

Why purchase lawyers professional liability insurance through NLADA Mutual?

Because we are an insurance company that shares the mission of advancing equal justice and as a mutual insurance company, we are a company owned by its members. All net proceeds remain in the equal justice community to support the work of advocates, like you, on the frontlines and NALADA’S efforts on their behalf. We are also a fierce advocate for justice and equity within the insurance industry.

What is the relationship between NLADA Mutual Insurance Co., RRG and National Legal Aid & Defender Association (NLADA)?

NLADA created its own insurance program in 1994 to better service its members. The insurance program evolved into a mutual company (NLADA Mutual) in 2022 where its member-insureds are owners in the company. Since the company was created by and for NLADA members (and the equal justice community), the net proceeds go back to NLADA and the community to support NLADA’s mission.

Do I have to be a member of the National Legal Aid & Defender Association (NLADA)?

Yes, NLADA Mutual member-insureds should hold membership with the National Legal Aid & Defender Association (NLADA) which provides many benefits to legal aid and defense practitioners and the equal justice community. For more information, please contact [email protected].

What are the coverage limits that can be purchased?

Limits start as low as $100,000 and go up to $5,000,000.

What deductibles are available?

Available deductibles are $0 - $5,000 depending on the policy limit.

What coverage can be purchased?

  • Lawyers Professional Liability 
  • Management Liability/Directors and Officers 
  • Employment Practices Liability (must be purchased with Management Liability)

What other coverages are provided?

The following coverages are automatically included in the lawyers professional liability policy:

  • $50,000 of Disciplinary Proceedings Expense 
  • $50,000 of Equitable Relieve Defense Coverage 
  • Subpoena Assistance coverage, within the limit of the policy

Are pro bono and/or contract attorneys covered under this policy?

Per our policy language, any lawyer (employee, contractor, volunteer) that provides professional services on behalf of the named insured is covered as an insured per the limits and conditions of the policy. See Section D.  Definitions, 2. Insured, for the full definition of Insured.  Refer to your policy for all other policy languages.

What does “defense within limits” mean?

This means that all defense costs, such as attorney fees, court costs, investigation and legal filing papers, are deducted first from the policy limit, which cuts into the overall limit of dollars available to pay for monetary damages awarded by a ruling.

What factors impact my premium?

Your policy premium is based upon the number of attorneys (full time, part time, volunteers and contractors) working for your program. Other factors such as the areas of practice, policy limit, and deductible will also impact your premium each year.

Does my policy include D&O (Directors & Officers) coverage?

D&O coverage, which is referred to as Management Liability coverage, can be purchased separately.  The limit of liability and deductible for this coverage would match the Lawyers Professional Liability limit and deductible.  Refer to your declarations page to confirm if the coverage is in place.

What is NLADA Mutual’s AM Best rating?

NLADA Mutual Insurance Co., A Risk Retention Group is proud to have a Financial Strength Rating of A (Excellent) and a Long-Term Issuer Credit Rating of “a” (Excellent) from AM Best. Effective Feb 2024. For the latest Best’s Credit Rating, access www.ambest.com.

Can premiums be paid electronically?

Yes, electronic payments can be made through the link below.  Credit/debit card fee is 3.5% and ACH fee is $3.  The maximum payment per transaction is $50,000.

I hired a new attorney after my policy started. Do I need to contact you to add the attorney to the policy for that person to be covered?

No, the policy automatically covers new hires for the rest of the policy period, so a change to your policy is not needed. You are responsible for updating the attorney list at your next renewal. However, if you start a new program, please see question #3.

My organization has started a new program. Do I need to contact you for the new program to be covered?

Yes, we ask that you provide us with a detailed description and expected areas of practice for the new program. We will then use the additional information to determine if we will be able to provide coverage for the attorneys working in the program and if there will be an impact to the policy premium.
